Tally terms of service
These terms cover the Tally app and this website. Tally is run by Felix Bose, Talstraße 53, 40217 Düsseldorf, Germany, at felix.bose@icloud.com. By using Tally you agree to them.
What Tally is
Tally is an app for a household's shared grocery list, recipes and meal plan, with an assistant that plans meals and a list that sorts itself for the shop you're in. Features can change, be added or go away; if something important goes, we'll say so in the app.
Your account
You need an account (Apple, Google or email) and must be at least 16. An account is for one person. Keep your sign-in to yourself; what happens through your account counts as yours.
You can delete your account at any time in Settings › Delete account.
Households
Everything in a household is shared by its members: they see and change the list, recipes, plan and comments. Anyone with an invite link can join the household, so give it only to people who belong there, and reset it if it gets out.
Someone who leaves a household takes their chats with them; what they put on the list, in the recipes or in comments stays for the others.
Your content
What you put in Tally stays yours. You let us store it, show it to your household and process it as Tally needs to, including through the service providers named in the privacy policy (such as the language model provider for the chat).
Only upload what you're allowed to share, and nothing illegal. Recipes from links, photos or other services are for your household, not for publishing.
Recipes from other services
When you import from Chefkoch, Cookidoo or another service, you sign in to that service yourself, on your iPhone. Tally isn't part of, or endorsed by, any of them, and their terms apply to your account there. If a service changes its pages, an import can stop working.
The assistant and other AI features
The chat, recipes from links, sorting into sections and fitting recipes to your diet use a language model. Its answers can be wrong or incomplete. Check recipes, amounts, cooking times and nutrition yourself.
Don't rely on Tally for allergies or intolerances: always read the ingredients on the pack. Goals like "Weight loss" or "Muscle gain" are cooking preferences, not medical or dietary advice.
Everything the assistant changes on the list and the plan can be undone.
Fair use
Use Tally for your household: not automated, not for resale, and not to disrupt the app, its limits or other people. So that Tally works for everyone, the chat and recipe links have daily limits; the app tells you when you reach one.
If someone breaks these terms, we can suspend or delete their account. Unless it's serious, we'll tell you first.
Tally Plus
The list, recipes, plan and smart sorting are free. Tally Plus is a subscription for the whole household with more chat and recipe links; what it includes and what it costs is shown in the app before you buy.
You buy Plus from Apple. It renews automatically until you cancel it in your Apple Account settings at least 24 hours before the period ends. Payment, refunds and your right of withdrawal go through Apple and follow Apple's terms.
Plus is for the household you bought it in, and you can move it to another of your households. If you leave the household, Plus ends there; your subscription runs until you cancel it with Apple.
Availability
We work to keep Tally running, but can't promise it's always available or free of mistakes. Maintenance, problems at our service providers or new versions can interrupt it for a while.
Liability
We're liable without limit for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
For slight negligence we're liable only if we breach an essential obligation (one that makes using Tally possible in the first place and that you may rely on), and then only for the foreseeable damage typical of such a case. Otherwise we're not liable for slight negligence.
Apple
These terms are between you and us, not Apple. Apple's Licensed Application End User License Agreement also applies to the app. Apple isn't responsible for Tally or its content, has no obligation to provide support or maintenance for it, and isn't responsible for claims relating to the app, such as product liability, consumer protection or intellectual property claims; we are, as far as these terms and the law provide. If the app fails to conform to an applicable warranty, you can notify Apple, and Apple may refund its purchase price; beyond that, Apple has no warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You confirm that you aren't located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you aren't on a US Government list of prohibited or restricted parties.
Changes
If we change these terms in a meaningful way, we'll tell you in the app or by email at least four weeks before. If you don't object by then and keep using Tally, the new terms apply; the notice will remind you of that. If you object, you can delete your account.
Law and disputes
German law applies. If you're a consumer, you keep the protection of the mandatory laws of the country you live in.
We're neither obliged nor willing to take part in dispute resolution before a consumer arbitration board. Write to us instead; we can usually sort it out.
